For example it would not be illegal to consider criteria for a particular role in a movie that has a disparate impact on age if the part calls for someone of a particular age. In other words the ADEA permits employers to discriminate based on age considering age is legitimately necessary under the circumstances. The Supreme Court then agreed to hear the case and eventually reversed the Second Circuit and reinstated the jurys finding that Knolls policy unlawfully discriminated because of age. In reaching its conclusion that the employer has the burden to prove the reasonable factors other than age defense the Supreme Court looked at another provision of the ADEA the bona fide occupational qualification defense. Twenty-eight of those 33 employees sued under the ADEA claiming Knolls illegally fired them because of their age. Knolls totaled those scores and gave the employees additional points based on their years of service. The company had its supervisors rate their subordinates based on their performance flexibility and critical skills. The BFOQ defense states that it is not unlawful for an employer to take adverse employment actions otherwise prohibited by the ADEA where age is a bona fide occupational qualification reasonably necessary to the normal operation of the particular business. The Supreme Court ruled that if an employer seeks to rely on that defense. Specifically the jury found that although the plaintiffs did not prove that Knolls intentionally discriminated against them they did prove that Knolls method of deciding who to lay off disproportionately harmed older workers. Thirty of the 37 salaried employees the company laid off were at least 45 years old. In that case Meacham versus Knolls Atomic Power Laboratory the Supreme Court interpreted a provision of the ADEA that permits an employer to take an adverse employment action against an employee. It has the burden to prove that its decision was based on a reasonable factor other than age. It then used those totals to decide who to lay off. As long as the adverse action is based on reasonable factors other than age. Even if the employment action is otherwise prohibited by the ADEA. In Meacham Knolls Atomic Power Laboratory was planning to lay off a number of employees. At the trial a jury found Knolls had violated the ADEA because its layoff procedure had a disparate impact based on age. A lawyer from s Hertogenbosch won from a in Mount Vernon New York The United States Court of Appeals for the Second Circuit initially affirmed the jurys findings but after the United States Supreme Court asked it to reconsider the Second Circuit reversed itself and ruled in favor of Knolls. Getting hitched, taking the plunge, tying the knot, jumping the broom–whatever you call it, chances are you know it ain’t cheap to say “I do.”

But do you know the real sticker price of a wedding these days? You may want to have a seat for this one. According to a 2005 survey by The Fairchild Bridal Group, the average cost of a wedding is $26,327. And no, that’s not a typo.

So that’s the bad news. The good news is that you can do it for less and still have the wedding of your dreams. And you won’t have to cut your guest list down to 10 or have a cash bar at your reception.

But before you begin crunching numbers and cutting budgets, figure out which elements of your wedding are most important. Start with a list of the major bridal expenditures (cake, ceremony/reception location, flowers, food, formal wear, honeymoon, invitations, music, photographer, and videographer) and rate them in numerical order. Once you’ve done that, you’ll have a better understanding of your expectations for your wedding.

So on to the free advice…

Not all ‘weddings on a budget’ advice has to focus on settling for the next best thing. There are lots of ways to save money and still get precisely what you always dreamed of having. For example:

- Once you’ve picked out the perfect wedding gown, go online and see if you can find a better price. - Instead of hiring a professional videographer, get a friend or hire a student from your local university to do the handiwork.

- Ready-made favors can cost upwards of $3 per person. And most of the cost associated with these little tokens of appreciation is labor. So make them yourself…it’s not that hard and can be lots of fun!

- Instead of buying expensive, personalized thank you cards, buy boxed thank-you cards. You can find beautiful ones at a card store, bookstore, or stationer.

- If your guests aren’t big on dancing, think about skipping the DJ or band. Instead, hire a solo musician for a romantic touch.

- If you’re having an outdoor ceremony or reception, use potted plants instead of expensive floral arrangements. Not only will you save money, but you’ll get to take the flowers home and watch them grow through the years.

- Have your reception at a local restaurant. Many don’t charge a location/rental fee AND you won’t have to rent tables, chairs, or linens.

Planning a wedding on a budget doesn’t have to be painful. And it certainly doesn’t mean that you can’t have everything you always dreamed of. It’s about being spending your money wisely…and perhaps saving a little so you can buy furniture AFTER the wedding.

I have yet to see a business that, sometimes in spite of themselves, didn’t benefit from implementing a Customer Relationship Management (CRM) or a simpler Contact Management software solution.

Your small business might be the rare exception, but if you can relate to some of the following scenarios, you may be ready to take advantage of the improved and inexpensive CRM systems coming on-stream.

Mary, your star sales performer, has just been poached by your opposition. She departs your employ with immediate effect. You are left wondering:

What deals was she working on?

What is the status of those deals?

Mary’s replacement would be able to hit the ground running, taking over where Mary left off if you have a small business CRM solution installed.

You need to do an e/mail marketing campaign to your customer base, but even the simple task of extracting a targeted list of all your client’s names and addresses proves difficult. And you haven’t even begun to send out your mailer yet, never mind manage and follow through with your responses.

Your sales people spend an inordinate amount of time preparing themselves for the next day, deciding who they are going to call or visit. These are all reports that could be generated at the touch of a button, and winging their way to your inbox with another, if you have the right CRM solution in place. You could even, depending on your choice of CRM solution, have reports extracted and forwarded to you automatically.

Nobody can sleep well in the knowledge that their biggest asset, their customer database, is in a mess! It may look pretty, but does it work?

Here are some other possible questions that you need answers for; the facts may remain elusive without the benefit of a functional CRM solution.

Why did you lose that deal?

Just when did you promise to get back to ACME Inc., after their budget gets approved?

Exactly how much did you quote them?

Who last engaged with that client from your sales/service or accounts departments; when, and what transpired?

When does their contract with your competition or with you expire?

What is the weighted value of those potential deals, forecast for the next x months?

You have a great new deal sweetener and need to get a mailer, fax shot, emailer out to your clients in a hurry, but how?

Who are your VIP customers – by region, product, rep or any other user-defined category? How do you rate or profile them?

You can’t pinpoint just why Johnny is having problems closing deals.

You want to sell your business but you can’t show your prospective buyers a professional, current list of your pending deals or active clients, the goodwill that makes much of the real value of any business.

These are just a few of the questions a competent CRM application should be able to answer for you.

American Wedding Practices

Living in the US makes one feel free to do anything, free to live, free to love, free from traditions. And while this is true, there are still many practices done during wedding that renders this memorable event with a distinct American touch. Here are some of them:

Starting from the engagement, Americans can think of unique ways to personalize their wedding. As there really isn’t any engagement tradition, the more unique the marriage proposal is done, the better.

For most wedding preparations, the engaged couple visits their parents to notify them of their recent engagement.

At times, the engaged couple hosts an engagement party. The engagement party costs less than a wedding reception since most of the time, the menu will only include cocktails and hors d’oeuvres. Therefore, if the couple is on a tight budget, they can just invite more guests to the engagement party if they plan to limit the number of guests during the wedding.

Most wedding preparations have a bridal shower given by the maid of honor and the bridesmaids. The groom may also have a bachelor party the night before the wedding but he has to be careful not to drink too much.

Wedding invitations should include response cards to quickly inform the couple whether the person has accepted or declined the invitation. The wedding invitations should also be sent within four to six weeks before the event.

Usually, there is a rehearsal dinner in which the wedding party and guests came from far places to be present at the wedding attend. It was the practice that the groom’s parents pay for this dinner.

A bridal luncheon may be hosted for the bride’s attendants during the wedding day. However, time constraint may not permit this to be part of the schedule for the wedding day. Likewise, the groom may also host a groom’s dinner for his groomsmen.

Interestingly, even if the couple is not very religious, they still prefer a religious ceremony. However, this may pose a problem since in America people of different faiths and religious backgrounds get married.

Even if there are few people who believe in bad luck, some couples still make sure that the groom does not see his bride until she starts waking on the aisle.

It is still practiced that the groom and his groomsmen enter the church through a side door. The bride will then walk down the aisle with her father. In some cases when both her father and stepfather brought up the bride, she may ask them both to escort her.

During a formal reception, there is usually a bridal table where the couple and the attendants sit. Also, food and drinks should be served as the guests appear at the reception.

Before, gift giving used to depend on what the guest will feel useful for the couple. Now, it is better to register for gifts so the guests will know what to bring that the couple will need.

Upon receiving an engagement or wedding gift, it is better to send a thank you note apart from saying “thank you” to the giver. This should be sent within two weeks upon receipt of the gift. Make a personalized thank you note, instead of using an impersonal generic thank you note.

These are just some of the many American practices during weddings. Whether one chooses to this or prefers to have a very different wedding, what’s more imperative is that American’s still believe in the wedding vow, “For better or worse, ’til death do us part.”

Franchise All World Governments

Many have debated whether we should have “One World Government” or not? And indeed the tries so far have somewhat under whelmed us all, as it seems whenever we get everyone together they all have different ideas on how civilizations should be run and all wish to do things in their own way. It is hard to try to merge all the world government into one cohesive group, as it may mean they will be giving up some power and control for the betterment of all. This is a hard thing to ask of a hard headed steadfast leader, which is one of human traits one must have to be a leader in the politics of human civilizations in the first place.

What if the World Governments operated like a Franchise. The UN, the Franchisor could be like a Franchise Opportunity for emerging Nations franchising their government structure. Regional Areas could operate like Master Franchise Opportunities and each Nation could be a Franchisee. Then everyone would be part of the same team and join in a common cause to battle disasters, disease and human rights for the betterment of all mankind; A franchise for the human race?

If we set up the World Franchise Systems, while simultaneously set up the next human generations for success and not failure; then the plan with the proper synergy could work. For those who chose to live longer through life extension technologies, they could life within a safer world without the chaos and strife and be a testament of the past periods and be sure not to let poor planned history repeat. A World Franchise System could easily be translated into every language and using current technology and we could accomplish our mission of world cooperation and work towards a common cause. Then the move towards a one-world government would not be in vein as we would then be able to fix the world in our present period and set in motion a plan, which can work far into the future. Real Estate And Marketing; Part 1

There are two aspects of real estate and marketing that are paramount to your success as a real estate professional; the acquisition of new customers and the retention of old ones.

As is the case in other industries the cost of acquiring new customers is escalating. So, it becomes more prudent to continue marketing to past customers. It’s less expensive and can be equally profitable.

However, many real estate agents, to their financial detriment, often fail to maintain relationships with clients they have “closed” deals on.

Take you for example. If you’re like the majority of agents you probably spend a lot of time, money and effort acquiring new customers; and heaven knows it’s anything but easy. But how effective are you at retaining past ones?

You probably feel, real or imagined, pressure to make the next “close”, but in doing so you are leaving a lot of money on the table. Actually, it’s more like you’re putting money into a competitor’s pocket.

Marketing to past clients can be especially rewarding. You probably shared a genuine care for each other, and if they were satisfied with you and your services in the past, there is a greater chance than not that they will come back to you for future transactions. Also, they are likely to refer friends, family and colleagues in the interim.

Savvy real estate and marketing pros immediately shift their strategy to building long term relationships once they “close” buyers.” You should, too! Rather than simply abandoning a client after a sale continue nurturing the relationship, but in a different way.

Savvy real estate and marketing pros also, maintain continuous, routine and ongoing contact and relations with past clients. This helps to you protect your customers/business from competitive encroachments.

For example; put them on an every other month “post sale marketing campaign”, whether it’s via post cards, letters or flyers.

Something is better than nothing, and it doesn’t have to cost a lot of time or money. The alternative is to do nothing and let a competitive agent convert them to their client! If you snooze you’ll lose!

An old friend once said. “Sometimes it’s better to keep what you got than to replace it with something new.” Avoid the pain of seeing a recent past client transact a real estate deal with another agent. Don’t let them get away – you spent too much time and energy converting them into a customer.

Home Sellers – Surviving the Home Inspector

*Be way out in front of the curve, hire your own inspector and complete the repairs before placing your home on the market. A good real estate agent will suggest that you hire an inspector on any home that at first glance says I need help. You could spend $200 to $500 but getting to it first may help you make a sale and get you a higher price.

*Don’t cover anything up, don’t hide problems. They will be found if not by the inspector then when the buyers’ final walk through before closing after you’ve moved all your furniture out. How would you like to move back in or spend 2 weeks in a hotel while the repairs are being completed so you can close and move to your next house, if that deal didn’t already fall apart?

*Basement problems, wet walls or floor? Most times covered by stacks of boxes or other things stored away, inspectors don’t move things they only check where they have access. The point is this will come back and bite you, basement problems are sometimes a very easy fix clean and repair gutters regrade around foundation so water moves away, a leaking hose bibb (outside faucet).

*Painting and touch ups should be done inside and outside a clean fresh look will give everyone confidence in the rest of the property. Painting the front door and entry is the best place to start. Hallways and corners always show a lot of use.

*Cleaning interior and exterior get rid of all the junk you plan on tossing anyway. Too much stuff in the house may be cause to question what’s behind it or underneath of it. Wash off any mold or mildew from your siding and roof.

*Landscaping trim all shrubs around the foundation, tall shrubs cause moisture to stay on walls and foundations a good place for termites and wood rot. Shrubs also hide your house what else are you hiding? This can cause a lot of questions from a home inspector and pest control inspectors they both know they usually find something here.

Each of these can help you make your sale. Home inspectors are not the enemy remember your buyers agent will suggest that you hire an inspector for your purchase.
